Upon your acceptance, these Terms of Service form a legally binding agreement between you and Creative31minds Consultants Pvt. Ltd. Our Services are available to you only upon your acceptance of these Terms of Service. In case any of the terms are not acceptable to you, please do not proceed to subscribe to any of our Services offered through the CreativeConnect portal available on www.preschoolcoach.in YOU AGREE TO BE BOUND BY ALL THE APPLICABLE TERMS OF SERVICE.
We periodically update these terms and we will let you know when we do through an email that you have used to access your Subscription Services (if you have one), and by posting a revised copy on our website. You agree to review these Terms of Service on a regular basis and always remain in compliance.1. DEFINITIONS 1. “Creative31minds Consultants Pvt. Ltd.”, “PreschoolCoach“, “CreativeConnect” “we“, “us” or “our” shall mean the same: 2. Creative31minds Consultant Private Limited, a company incorporated under the Companies Act, 1956, with its registered office at Office No.8, Basement, Swaralat Apartment, Off Gokhale Road, Thane (W), Maharashtra, 400602 3. “You“, “your” or “Customer” shall mean an individual or legal entity who is signing up for any kind of Services from us, irrespective of the nature or duration of the Services, including those availing of Free Services if offered under any offers mentioned on the website. Customer’s details, including the name of the contracting entity and the authorized representative, are as provided in the accompanying Sign up Form. 4. “Billing Cycle” shall mean a duration cycle for which billing is done in one go, as indicated in the Pricing section of the website. 5. “Consulting Services” shall mean the professional services provided by us, which may include training services, installation, integration or consulting services. The details of the Consulting Services shall be set out in the Sign up Form signed up from time to time under these Terms of Service 6. “Customer Data” shall mean information pertaining to your clients that you submit or collect via the Subscription Services. Additional information that may be collated by us and provided for your use will not be included within the scope of Customer Data 8. “Effective Date” shall mean the date of your acceptance of these Terms of Service 9. “Force Majeure” shall mean an act of war, hostility, sabotage, act of God, electrical, internet, or telecommunication outage, cyber-attacks, government or regulatory restrictions (including the denial or cancellation of any export or other license), or any other event outside the reasonable control of the obligated Party 10. “Free Services” shall mean any products or features, including Subscription Services made available by us to you on an unpaid trial or free basis as mentioned under any specific offers on social media or website. 11. “CreativeConnect Portal”, or “Platform” shall mean the suite of applications available at https://www.preschoolcoach.in/ or any of its sub-domains or any other URL/location made available by us 12. “Sign up” or “Sign up Form” shall mean the form submitted by you, with your details and the Services opted by you, with relevant Service terms, pricing and payment terms being set out accordingly. Sign up Form may be updated or modified from time to time with mutual Consent 13. “Party” shall mean either Creative31minds Consultants Pvt. Ltd. or Customer and “Parties” shall mean Creative31minds Consultants Pvt. Ltd. and Customer collectively 14. “Planned Downtime” shall mean the period during which the Services may be shut down for planned maintenance of the Platform. To the extent possible and reasonable, such downtime will be scheduled during non-business hours for majority of our customers such as weekends and public holidays and at least 24 (twenty-four) hours’ prior notice will be provided 15. “Privacy Policy” shall mean our privacy policy set out at www.creativeconnect.preschoolcoach.in/privacypolicy 16. “Sensitive Information” shall mean passwords, financial information such as bank account or credit card or debit card or other payment instrument details, Social Security numbers, passport numbers, driver’s license numbers, Aadhar numbers or similar identifiers, information pertaining to racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, physical, physiological or mental health condition or information, medical records and history, sexual orientation, genetic data, biometric information, or other employment, financial or health information, including any information subject to regulations, laws or industry standards designed to protect data privacy and security, such as the Health Insurance Portability and Accountability Act and the Payment Card Industry Data Security Standards 17. “Service Fees” shall mean the amounts you are required to pay for using any of the Services 18. “Services” shall mean any service provided by us to you, including but not limited to Subscription Services, Consulting Services and Free Services 19. “Start Date” shall mean the date of commencement of the Subscription Services 20. “Subscription Fees” shall mean the fees payable by you for the Subscription Services 21. “Subscription Services” shall mean all of PreschoolCoach web and mobile based marketing and sales applications, tools and platforms that you have subscribed to and are developed, operated and maintained by us, accessible via https://preschoolcoach.in or another designated URL, and any ancillary products and services that we provide to you. The details of the Subscription Services shall be as set out in the Sign up Form 22. “Subscription Term” shall mean the initial term for the subscription to the applicable Subscription Services, as specified in the relevant Sign up Form, and each subsequent renewal term (if any). For Free Services, the Subscription Term will be the period during which you have an account to access the Free Services 23 “Terms of Service” shall mean this Terms of Service entered into between MyPreschool and you in respect of the Services, along with any modifications that may be notified from time to time 24. “Users” mean individual people or accounts that are designated and authorized by you to access Subscription Services. The Subscription Fees will remain unchanged during the Subscription Term of the Sign up Form and be subject to escalation only at the time of each renewal, at the rate set out in the relevant Pricing section. In case Services are being procured for only a portion of a month during initiation of Services, the Subscription Fees will be charged
SCOPE OF SERVICES
1. Every month 10 static posts will be designed and scheduled on your preschool social media platforms like Facebook page & Instagram provided to us during the onboarding process. 2. 10 posts designed and scheduled will be mainly special day wishing posts like Raksha Bandhan, Childrens Day, Republic day, etc pertaining to the special days chosen by our content team for that particular month. 3. No approvals will be taken from the client for these 10 posts. 4. Apart for the 10 social media posts, client can raise upto 8 artwork requests for any additional posts or artwork required in that month. 5. Credits will be allotted for each artwork depending on the type of artwork, and time and efforts taken by the designer to design them. Content for all artwork requests raised wil be provide by the allotted content writer through the CreativeConnect online portal. 7. All content-related queries are to be shared with the content manager manager to you. 8. All paid campaigns as requested by the client will be considered for designing and publishing only after raising a paid campaign request on the creativeconnect portal. 9. The paid campaign budget will be considered as per the data added during the paid campaign request 10. Paid campaign budget amount is not included in the service/subsription fees paid during the sign up. 11. All pictures uploaded on the CreativeConnect before 3.00 pm everyday will be uploaded on your Facebook page/Instagram on the same day. Pictures uploaded after 3.00 pm will be uploaded on the next day after 12:00 noon 12. While uploading the pictures, if the “Upload on Google” check box is ticked, the same pictures will also be uploaded/published on Google Business for your preschool. 13. All creative artwork requests sent only through the CreativeConnect portal will be considered. No artwork requests will be considered through WhatsApp, Email, SMS, Phone call or any other medium of communication. 14. The dedicated designer assigned to your preschool can take between 12 hours to 48 hours to deliver or more to design and deliver the artwork depending on the type of artwork. 15. All birthday requests for the next month are to be shared through the CreativeConnect portal before the 25th of every month. No birthday requests will be considered through WhatsApp, Email, SMS, Phone call or any other medium of communication. 16. Open file for artworks designed by the designer can be shared with the client only on special requests through email and approval from the head of the department. 17. For any artwork, only 3 revisions will be considered. 18. Event request is to be raised on the creativeconnect portal for any upcoming events. Event request to be shared share 1 week prior to the event. 19. All activity pictures/videos will be accepted only through the creativeconnect portal. We will not accept them through WhatsApp, Email, SMS, Phone call or any other medium of communication.
